Indiana HOA Overview

Indiana HOA Act (IC 32-25.5) was adopted in 2009 and provides basic protections for homeowners. Condos governed under IC 32-25. Requires written notice before fines.

Notice of Fine

Mandatory

Before imposing a fine, the HOA must give the member written notice and an opportunity to cure the violation. A hearing must be offered before the fine is final.

Disclosure Statement

IC 32-25.5-7

Mandatory

Seller must provide buyer with a copy of all governing documents. No specific turnaround time mandated by statute.

Retention: 5 years
Disclosure: Provided to buyer by seller prior to closing.

Notice of Assessment Lien (Indiana)

Written notice to a delinquent member that the association intends to record an assessment lien, specifying the amount due and a cure period.

Formal grievance form allowing members to submit complaints or disputes to the board for resolution, in compliance with Indiana HOA Act dispute procedures.
