Maryland HOA Overview

Resale packages must be delivered within 20 days. HOA liens are subordinate to first mortgages. Requires a "Maryland HOA Disclosure" for all resales.

Mandatory20 days

HOA must provide a resale package within 20 days of written request. Fee is capped by statute. Package must include: declaration, bylaws, rules, current budget, reserve study summary, and disclosure of any pending assessments, violations, or litigation.

Retention: 5 years
Disclosure: Provided to seller (for buyer) within 20 days of request.

Annual Budget

Md. Code, Real Prop. § 11B-111

Mandatory

Budget must be adopted and a copy provided to all lot-owners at least 30 days before the fiscal year begins.

Retention: 7 years
Disclosure: Distributed to all lot-owners at least 30 days before fiscal year start.
