North Carolina HOA Overview

Requires "Executive Session" summaries to be published (not full minutes — just topics discussed). HOA must provide written notice of all fines before they are imposed.

Executive Session Summary

N.C.G.S. § 47F-3-108(b)

Mandatory

After each executive session, the board must prepare and distribute a written summary of the topics discussed (not the full minutes). Full executive session minutes remain private.

Retention: 7 years
Disclosure: Distributed to all members at the next regular meeting.

Notice of Fine

N.C.G.S. § 47F-3-107.1

Mandatory15 days

Board must give the owner written notice of the fine at least 15 days before it is due. Owner has the right to a hearing before the fine is imposed.

Retention: 7 years
Disclosure: Sent by first-class mail to the owner's address of record.

Disclosure Statement (Resale)

N.C.G.S. § 47C-4-109 (Condo), § 47F-4-109 (HOA)

Mandatory7 days

Sellers must provide buyers with a "Resale Certificate" or "Public Offering Statement" within 7 days of contract execution. Buyer has 7 days to rescind after receipt.

Retention: 5 years
Disclosure: Provided to buyer by the seller within 7 days of contract. Buyer has 7 days to cancel.

North Carolina Planned Community Resale Certificate

Mandatory

N.C.G.S. § 47F-4-109

Resale certificate provided to a buyer within 10 business days, disclosing current assessments, reserve fund balance, pending litigation, and violations.

Required at every unit resale

Fine Hearing and Due Process Notice (Ch. 47F)

Mandatory

N.C.G.S. § 47F-3-107.1

Required written notice to a member of a scheduled hearing before the board or a hearing panel on a proposed fine, providing at least 15 days' notice and the right to be heard.
