New Jersey HOA Overview

PREDFDA requires extensive developer disclosures for new communities. The Condominium Act (N.J.S.A. 46:8B) governs condos separately. No single HOA statute for existing communities; relies on CC&Rs and general law.

Master Deed / Declaration

N.J.S.A. 46:8B-9 (Condo)

Mandatory

Must be recorded at the county. For new communities, a Public Offering Statement must be registered with the DCA before any sales.

Retention: Permanent
Disclosure: Filed at county. Provided to any buyer as part of closing package.

Public Offering Statement / Resale Package

N.J.S.A. 45:22A-36 (PREDFDA)

Mandatory

For new communities, a Public Offering Statement registered with the DCA is required. For resales, buyers must receive a copy of all governing documents and financial statements.

Retention: 5 years
Disclosure: Provided to buyer prior to closing.

ADR Alternative Dispute Resolution Notice (NJ)

Required notice informing members of their right to pursue alternative dispute resolution before the association initiates legal action under PREDFDA.

Mandatory

N.J.S.A. 45:22A-45.1 et seq. (Radburn Act)

Candidate nomination form compliant with New Jersey's Radburn Act, which guarantees homeowners' rights to run for and vote in HOA board elections.
