New Mexico HOA Overview

Meeting minutes and financial records must be made available to members within a reasonable time (typically 10 business days) of a written request.

Disclosure Statement

NMSA § 47-16-10

Mandatory10 days

HOA must provide a disclosure statement within 10 days of written request.

Retention: 5 years
Disclosure: Provided to buyer within 10 days of request.

Disclosure certificate provided to a prospective purchaser summarizing current assessments, pending special assessments, reserves, and any known violations under the NMHAA.

Violation Cure Notice (New Mexico HOA Act)

N.M.S.A. § 47-16-14

Written notice to a member of a governing document violation providing a minimum 30-day cure period before the association imposes fines or takes enforcement action.
