Ohio HOA Overview

Strong condo statute but no general HOA act. Planned community HOAs are governed by CC&Rs and general law. Ohio Nonprofit Corporation Law (ORC 1702) provides governance framework.

Reserve Fund Account

ORC § 5311.081

Mandatory

Condo associations must maintain a reserve fund for capital expenditures and deferred maintenance. The amount must be disclosed in the annual budget.

Retention: 7 years
Disclosure: Reserve balance and funding plan disclosed in annual budget.
Threshold: Required for condos under ORC 5311.

Disclosure Certificate

ORC § 5311.25

Mandatory10 days

Unit-owner association must provide a "Disclosure Certificate" within 10 days of written request. Includes: unpaid assessments, pending violations, and planned special assessments.

Retention: 5 years
Disclosure: Provided to buyer within 10 days of request.

Rules Enforcement Notice (Ohio)

Mandatory

Ohio Rev. Code §§ 5312.01 et seq.

Written notice to a member of a governing document or rules violation, citing the specific provision violated and the cure or hearing process.

Assessment Lien Certificate (Ohio)

Mandatory

Ohio Rev. Code § 5312.12

Certificate of lien filed with the county recorder for unpaid assessments, taking priority over all other liens except property taxes and first mortgage liens.
