Pennsylvania HOA Overview

Pennsylvania's Uniform Planned Community Act closely mirrors UCIOA. Requires a "Public Offering Statement" for new communities. Reserve study recommended but not universally mandated.

Resale Certificate

68 Pa. C.S. § 5407

Mandatory10 days

HOA must provide a resale certificate within 10 days of written request. Must include: declaration, bylaws, rules, current budget, reserve fund status, and any pending assessments.

Retention: 5 years
Disclosure: Provided to buyer within 10 days of request.

Annual Budget

68 Pa. C.S. § 5302

Mandatory

Budget must be adopted at a noticed board meeting. Members must be given reasonable advance notice.

Retention: 7 years
Disclosure: Distributed to all unit-owners at least 14 days before the start of the fiscal year.
