Utah HOA Overview

Covers planned communities (HOAs). Condo Act (Utah Code § 57-8) governs condos separately. Requires annual "financial review" and reserve fund disclosures.

Utah Code § 57-8a-301 et seq.

Mandatory10 days

Seller must provide buyer with an HOA Disclosure Document within 10 days of request. Includes: declaration, bylaws, rules, budget, reserve study summary, and any pending assessments.

Retention: 5 years
Disclosure: Provided to buyer within 10 days of request.

Reserve Fund Analysis

Utah Code § 57-8a-211

Mandatory

HOAs must maintain a reserve fund and prepare an annual "Reserve Fund Analysis" disclosing the projected costs of major repairs and the funding plan.

Retention: 7 years
Disclosure: Distributed annually to all members.

Notice of Non-Compliance (Utah UCAA)

Utah Code § 57-8a-306

Written notice to a member of a non-compliance event, providing a 30-day cure period and notice of the right to a hearing before fines are imposed.

Rules of Conduct for Meetings (Utah UCAA)

Mandatory

Utah Code § 57-8a-225

Board-adopted rules governing conduct at member and board meetings, including procedures for member comment periods, removal of disruptive individuals, and voting.
